摘要/Abstract
摘要：
我国现行的民办教育规范性法律文件在许多方面都存在不同程度的冲突,明显破坏了法制的统一性、权威性和实效性。其中,"非营利"概念界定的立法缺失,"合理回报"的法律性质在现实中被普遍曲解且缺乏配套的法律规定,民办非企业单位在法人体系中的地位不明确,以及民办教育地方立法中的政府和部门利益本位,成为民办教育法律冲突产生的根源。
Abstract：
The paper claims that Chinese private education law is not flawless in quite a few areas in violatingthe uniformity , authority and efficiency of the law. The ideasof non profit and reasonable reward are mistakenas groundless legal regulations in reality. In addition , the conflictsof the private representatives and non enterpriser private corporation system , and the conflicts of the governments and educational departments form thesource of the basic legal conflicts.
