摘要/Abstract
摘要：
人的利己本能,是先天存在的。而人的利己意识却是后天形成的,它受到人的利己本能以及物质资源有限性等诸多因素的影响,并随着生产力水平的提高、人类社会的发展而不断演进。在利己意识的主导下,人在处理个体与群体利益的关系时,亦可做出一些具有利他性或者互利性的制度选择与安排。正是人的利己本性(包含利己本能与利己意识)才是法律与道德得以产生的根源,是法律与道德之间关系的支点。
Abstract：
Human self.interest is congenital, and the human consciousness of self.interest is acquired with the influence of the basic instinct, limit of resources, productive power and degree of the social development. Despite the self.interest consciousness, human beings would make certain institutional arrangements and choices of altrustic or mutual benefit. This paper studies the self-interest nature as the pivot of law and moral.
