摘要：
高校招生实践中"推进法治"、"权利保障"、"公平正义"思想正成为理论研究和实践的主流。按照现代法治的理念,通过运用公共权力对招生资源进行分配,对招生过程中的社会关系予以特别的法律保障;或者运用公共权力,通过创造条件,排除妨碍等方式,以现代法治理念为高校招生的有序、均衡、和谐发展提供法律保障,是《国家中长期教育改革和发展规划纲要》中要求"推进依法治教"的题中应有之义。只有实现人文与法治的建构与对接,转换为规范化、制度化、程序化的法律保障,才能真正保护考生的合法权益,真正体现对考生的人文关怀。
Abstract：
The rule by law,right preservation,and equality form the mainsteam in the college enrollment.Resources are distributed in light of public power,social relations handled in accordance with law,and order and harmonious development enforced.Furthermore,the humane and legal measures combined together may provide with standardized system to protect the right of the students.
