高校法治工作机构的运行模式及其问题检视

Legal Work Organizations in Universities: Operational Modes and Challenges

摘要:

高校法治工作机构的运行是国家制度安排、高校管理体制和自身组织行为共同作用的结果。随着高等教育改革与依法治校工作的推进,法治工作机构作为高校建制化的专门工作机构得以确立和巩固、职责日渐明晰,成为高校治理体系中推动法治变革的重要力量。但高校法治工作机构作为一个新兴的工作机构,与高校其他传统工作部门相比,其运行机制还不够成熟,还存在着外部驱动与内部需求、新兴力量与传统格局、全局谋划与局部工作等多重矛盾,导致高校法治工作机构运行的内生动力不足、条块分割严重、事前预防与参与力度弱化等现实问题。为了提升治理效能,完善法治工作机构运行模式,高校应当进一步加强法治工作机构的顶层设计,促进外部驱动与内生动力的平衡,完善治理体系中不同主体的责权利关系,强化法治工作机制的实效性,不断推进高等教育法治化的高质量发展。

Abstract:

The functioning of legal work organizations within universities is shaped by the interplay of national institutional frameworks, internal university management systems, and the organizations’ own behaviors. With the ongoing reforms in higher education and the emphasis on governing universities in accordance with the law, legal work organizations have emerged as specialized institutions dedicated to the institutionalization of colleges and universities. These organizations have been established and strengthened, their responsibilities have become increasingly clear, and they have grown into a significant force in advancing the rule of law within university governance systems. However, compared to traditional university departments, their operational structures are still underdeveloped.As relatively new entities, legal work organizations in universities face several contradictions: between external pressures and internal needs, between emerging trends and traditional frameworks, and between strategic planning and localized activities. These contradictions give rise to practical challenges such as weak intrinsic motivation, organizational fragmentation, and a lack of preventative and participatory measures. To enhance governance efficiency and improve the operational effectiveness of legal work organizations, universities should prioritize top-level design, balance external and internal forces, clarify roles and responsibilities within the governance system, and increase the effectiveness of legal entities, thereby advancing the high-quality development of legal frameworks in higher education.
