中国的教育改革迫切需要制订《学校法》

A School Law is Imperative for Educational Reform in China

摘要/Abstract

摘要:

学校作为教育实施的主体,虽然有《教育法》等法律为保障,但是在涉及政府、社会、学校等多方面责权利关系时边界模糊,以及在教育资源公平分配、教育投资主体认定及国家教育目标实现等方面面临无法可依的局面。《学校法》将从法理层面明确各级各类学校办学主体、性质、目标,廓清政府、社会、学校的责权利边界,规范三方关系,进而建立现代学校制度。该法对于促进教育公平发展、保障国家教育目标的实现、推动依法治教具有重要的现实意义,当下应尽快将《学校法》列入立法规划。只有确立以人民为中心的立法思想,突破传统的以部门立法为主的方式,从国家层面确定立法主体,致力于立良法,才能充分调动相关办学主体的积极性、能动性和创新性,最终实现国家总体教育方针和全民教育理想。

Abstract:

As the organ that implement the work of education, schools are protected by the Education Law and other laws. However, when it comes to the responsibilities and rights of the government, society and schools, there are still blurred boundaries, and there is no legal basis for the equitable distribution of educational resources, the identification of educational investors and the realization of national educational goals. A School Law defines the subject, nature and goal of schools of all levels and types from the jurisprudence perspective, makes clear the boundaries of responsibilities and rights of the government, society and schools, standardizes the tripartite relationship, and thus establishes a modern school system. This law is of great practical significance for promoting the equitable development of education, ensuring the realization of the national education goals and promoting the administration of education according to law. At present, the School Law should be on the legislation agenda as soon as possible. Only by adhering to the people-centered legislation philosophy, breaking through the traditional department-oriented legislation, identifying the legislative body at the state level, and making efforts to enact good laws, can we give full play to the initiative, agency and innovation of the relevant school-running bodies, and finally realize the overall national educational policy and the ideal of education for all.
