On the civil society and rule by law in China—A meditation of the transition from commercial to civil society

摘要：
市民社会是现代法制社会的社会根基, 中国正处于商事社会这一由乡土社会向市民社会转型的过渡时期。欲建立现代法治社会与国家, 就要在中国构建市民社会, 也就是要推动我国商事社会向市民社会的转型, 而推动这一转型要启动一系列复杂的国家与社会工程。
Abstract：
It is claimed that the civil society is the foundation of the modern rule by law, and China is experiencing the transition from commercial to civil society. So the paper argues that the construction of the modern rule by law in China demands the construction of the civil society, which, in turn, is a complex social project in the state.
