The evolution of the duality of personalism
摘要/Abstract
摘要：
人格权的演进史表明,它是一种双重历史行进轨迹,在公法和私法中都有其广泛的生存空间。人格权制度从一般公法进入宪法,其根本原因在于:商品经济条件下,国家权力的政治合法性凸显。人格权制度在民法中的演进,是自然意义上的人格、社会群体意义上的人格、独立个性意义上的人格三者增量周延过程。
Abstract：
The history of evolution of personalism shows that it exists in both the common and private legislatures, enjoying a dual way of historical development. The system of personalism is elevated from common legislature to constitution owing to the political prominence of the national power. The evolution of personalism in the civil law reflects the process of growth of personalism in terms of natural, socially commune, independently individual features.
