On the infringement of intel lectual property rights and the liability principles

摘要：
知识产权侵权归责原则,既是一个理论问题,更是一个实践问题,也是法学界在围绕如何加强知识产权保护的讨论中所提出的一个热门话题。理论界对此已多有论述,但观点各异,尚无定论。综观各种观点,分歧的一个重要原因在于对一些基本概念的含义存有不同认识。
Abstract：
The infringement or violation of intellectual property rights (IPR) and liability principleshave remained a dispute in both theory and practice, and they have been a hot issue in the legal circle. Despite the heated discussions, there is no final conclusion. After a general survey, we find out that this is due to the misunderstandings of the basic conception. Hence, this essay is intended to clarify the basic concepts of IPR, in addition to its violation and liability principles.
