On the electronic transaction and the electronic contract
摘要/Abstract
电子交易由于其快捷等方面的优点,使得这一新的交易方式及由此产生的电子合同越来越受到人们的重视。较之传统的交易规则和合同法则,电子交易和电子合同有一些新的特点,法律关系和法律特征也呈现出一些新内容,研究电子交易双方的合同法律关系和电子合同的法律特征,是新时期发展电子商务的基础工作,有着十分重要的意义。
Owing to its speedy features, the electronic transaction and the ensuing electronic contract have attracted more and more attention. In contrast with the traditional rules of transaction and the traditional contract, the new electronic mechanisms do enjoy some unique contents and legal properties. Therefore, the writer of this paper argues for that it is a significant and essential work in the new age of the electronic commerce to explore into, the laws governing the parties of the electronic transaction, as well as the legal properties of the electronic transaction.
