On the rational principle of prediction and its perfection in Chinese laws
摘要/Abstract
摘要：
合理预见规则作为限制违约损害赔偿范围的一项重要原则,早已被两大法系和国际公约采用。我国自《合同法》颁布后,才将其适用于国内合同。正确地理解和操作该规则,尚须进一步完善立法,丰富司法经验。学界应重视合理预见规则的研究,为规则的适用提供理论支持.
Abstract：
The rational principle of prediction , long adopted by the two legal systems and international treaty , serves as a compensatory commitment to reduce the violations of contracts .It is not long since we have applied the predictable principle after Contract Law was passed in China , we need more proper understanding of the principle , furt her development of our legislation , accumulation of more experiences , and an in -depth exploration of the principle so as to supply with more theoretical supports of the predictable priniple .
