Terminating of the contracts for professional players
摘要/Abstract
摘要：
目前我国职业球员合同解除方面可借鉴欧美职业球员合同的相关经验进一步完善。除双方合意解除外,为了保证合同的稳定性,防止球员任意解约,应对球员单方解除合同进行限制;俱乐部单方解除虽有较大的自由度,可因球员过错、伤病、竞技表现等原因单方解约,但应有保障合同、签约金等保护球员权益。
Abstract：
The European experiences are worth learning in contracting for Chinese professional players. This paper differentiates the professional player contract from common labor contract. The termination may be done by mutual agreement, but the unilateral termination by players should be limited, except for the misdemeanors, injuries, disease, and lack of skill by the players.
