On the right of commercial secrets
摘要/Abstract
摘要：
从知识产权的定义考察，商业秘密权是一种非物质性的财产权利，其客体具有无形性特征，这种权利也是法定权利。因此，商业秘密权属于知识产权。商业秘密权具有期限的不确定性及风险性两大特征。从所有权角度考察，商业秘密与有形的物质财产有着迥然不同的自然属性，商业秘密权与有形财产所有权在具体内容上大异其趣。
Abstract：
Judging from the definition of intellectual property,the commercial secrets belong to a kind of non material legal property,which is characterized by its invisibility.Thus,the commercial secrets can be regarded as intellectual property.There are two features about the commercial secrets:uncertainty with time limit and risk.In the light of prprietary rights,the commercial secrets have their natural quality entirely different from that of material property.The commercial secrets and visible property are quite different in content.
