On protection of human rights by international criminal law
摘要/Abstract
摘要：
尊重和保障人权，是人类文明的标志。人权在现实生活中又外化为应有人权、法定人权、实有人权三种基本形态，而应有人权向实有人权的转化则是人类执着追求的共同理想。国际刑法正是根植于这一理念，在践行共同理想方面发挥着主要作用。
Abstract：
It's a symbol of civilization to respect and guarantee human rights.Human rights are embodied in three basic forms,i.e. ought to right,legal right and to be right. And the transformation from ought to rights to to be rights is our common ideal that human beings seek forever.The international criminal law is rooted in the concept and play a leading role in carrying out the ideal.
