On the legislation of the financial holding companies
摘要/Abstract
摘要：
制定《金融控股公司法》来发展金融控股公司具有重要意义。我国目前的相关规定层次低、不明确、相互矛盾,制定金融控股公司法十分必要。在立法时要注意以下问题:明确金融控股公司的立法模式、对不正当交易进行限制、规范监管体系、建立信息披露制度、加强反垄断法控制等。
Abstract：
It is thought of as a great event to establish a law of financial holding company for the sake of the financial industry.The current stipulation is,however,incompetent and contradictory.So the paper proposes that attention be paid,in the legislative process,to the model of legislation,regulating the improper deals,standardization of the supervision system,information exposure,and enhancing the law of antimonopoly.
