On the nature and legal improvement of the custody
摘要/Abstract
摘要：
监护制度是一项重要的民事法律制度, 对监护制度的完善是一个直接关系到家庭关系的稳定和对未成年人、精神病人人身与财产权利的保障的课题。我国现行监护制度在监护的性质问题上存在着非常模糊的认识, 有必要加以澄清。
Abstract：
The custody or guardianship is a significant item in the civil law. The improvement of the custody or guardianship ensures the family stability and legal protection of the rights and property of children and the diseased.
