A legal account of the ecological protection of th emining exploitation in the west
摘要/Abstract
现代意义的区域矿业开发, 不仅是经济问题, 也是生态环境保护问题, 更是法治问题。无论是中国自古以来开发西部的历史经验教训, 还是中国当前面临的诸多现实问题, 都要求走西部矿业开发与生态环境保护协调发展之路, 并以法治作为保障。为此, 要敢于观念革命;要使政府矿业环保管理纳入法制轨道;要健全矿业权市场, 实现法律调控与市场机制有机结合;要依法调整矿业开发环保中各方面利益关系, 形成统一领导, 协同发展的良好局面。同时, 还要建立和完善西部矿业开发环保的基本法律规范。并逐步改革相关的司法体制。
The conception of regional mining is not only an economic issue, an ecological and environmental protection, but also the rule of law. The western development and realities China faces at present time demand that a sustainable economy. Therefore, measures ought to be taken to encourage creativities, rule of law in the mining industry for environmental protection, and supervise the market mechanisms. Meanwhile, legal norms need to be established and legal reforms performed constantly.
