On the identification in the civil lawsuit
摘要/Abstract
摘要：
民事诉讼认证制度的目的就在于保障法官公平、公正地运用证据发现案件事实,防止法官在认证上的恣意与专横。我国民事诉讼认证制度应借鉴国外认证制度的有益做法,运用民事诉讼基本理论,选择自由心证与法定证据相结合的认证模式,建立完备的认证规则体系及明确界定认证的主体和范围。
Abstract：
The evidential identification of the civil lawsuit helps judges to come to open and just verdict.The writers argue that Chinese law institutions need to learn of the efficiency of the foreign system,and the principles of civil legislation,in order to build up the Chinese practical justification model.
