Right to strike in the Chinese constitution from the perspective of legal interpretation
摘要/Abstract
摘要：
近些年,频发的罢工事件引发作为财富公平分配机制的劳资双方谈判基础的罢工权的宪法思考,因我国现行宪法对此尚无明文规定,故有必要从法释义学角度反思我国宪法向度内的罢工自由。透过我国现行宪法中若干复数条款可以推衍出罢工自由,此种推导可以为我国未来宪政实践中新型权利的发展提供借镜。
Abstract：
Frequent strikes occur recently due to the unfair allocation of the wealth.It is not clearly stipulated in the Chinese constitution concerning right to strike of the labors,so proper legal interpretation should be considered.The writer deduces several articles of the constitution,and argues for the improvement of the new rights in the future constitutionalism.
