摘要/Abstract
摘要：
从传统文化和法治社会、和谐社会的内涵来看,我国存在引入刑事和解制度的有利因素。因此,构建我国的刑事和解制度,应从以下着手:1.以立法方式扩大非监禁刑的适用;2.在刑事诉讼法中增加刑事和解程序的规定;3.创造配套措施完备的司法环境;4.加强社区矫正工作的参与力度。
Abstract：
The criminal reconciliation system which originates from the western restorative justice mainly deals with criminal disputes.The state power,individual right,rights of the victim and criminal are given enough attention,and thus it is the manifestation of the humanism and harmony,in addition to the modern democracy,and legal system in the criminal judicature.However,the system has room for improvement before it suits Chinese realistic conditions.
