The diversification of the civil lawsuit and constitutional lawsuit proceedings
摘要/Abstract
摘要：
把民事诉讼程序的多元化界定为民事诉讼程序设置的多样性,有其重要的理论和实践意义,从理论上说,是实现法官职业的专业化,进而实现法官职业的精英化;就实践而言,可以保证公正与效率价值的实现。在多样化的诉讼程序的设计中,应当包括宪法诉讼的程序选择。
Abstract：
There are close relationships between constitution and civil lawsuit,because people's court tries and judges the First Case with the common proceeding of the civil lawsuit.The paper is intended to account for designed diversifications of the civil lawsuit proceedings,which,in theory,can be helpful with the career professionalism of the judges.So the design of the diversification of lawsuit should cover the selections of the constitutional lawsuit.
