On legitimacy of the most closed contact principle
摘要/Abstract
摘要：
最密切联系说是当代冲突法中解决法律适用问题时广为采用的一种学说,它最早发源于涉外侵权的法律适用领域。目前,随着各国民事交往的日益频繁,它正在向国际民事生活的各个领域渗透。最密切联系原则应该作为国际私法的基本原则列入国际私法的立法和理论中去。
Abstract：
The term of the most closed contact principle,extensively adopted in the conflict of laws,is initially used in the violation of the overseas laws.With the frequent global exchanges,it is also used in the global civil affairs.Hence,it tends to be included in the legislation and the theory of the private international laws as a cardinal principle.
