Mode,theories and principles of the rule by law in China
摘要/Abstract
国情的多样性决定了中国法治道路的多样性。中国法治道路的模式应是:法治规律+本国国情+自己的创造。具体体现在三个方面:价值取向、运行规律、策略选择；支撑中国法治道路发展模式的理论有三个相互联系的观点:法治方略论、法治价值论、法治功能论；中国特色社会主义法治道路遵循的基本原则:坚持党的领导、人民民主与依法治国的统一；贯彻以人为本的政治理念；坚持法治建设与经济社会发展相协调；正确处理好继承、借鉴和创新的关系。
Diversity of the nation speaks for the diversity of the rule by law.The legal rule of China is to follow the mode of legal regularity,specific situation and creativity,with three features of value orientation,operation and policy options.The supporting viewpoints include legal ruling policies,legal values and functions.Basic principles for Chinese socialist legal rule include the leadership of CPC,democracy and rule by law,man-based political conception,congruence of legal rule and socio-economic development.
