On the intellectual property right protection of the non-material cultural heritage
摘要/Abstract
摘要：
非物质文化遗产与知识产品同具有无形性特征,但非物质文化遗产具有公共财产属性,同时具有丰富的社会价值。知识产权属于私权,其专有性、时间性与非物质文化遗产之法律属性存在冲突。因此,非物质文化遗产的保护制度应以公法为主导,并辅之以私法保护,构建上位法与下位法密切衔接,一般法与专门法相互关联,公法与私法相互配合的系统、完善的非物质遗产保护法律体系。
Abstract：
Non-material cultural heritage and intellectual properties are both of intangible features,the former of which is of public and rich social values,and the latter the privacy.There is a conflict of them in legal attributions.Hence,the protection of the non-material cultural heritage should be embodied in public law accompanied by private law,general and special laws.
