摘要/Abstract
摘要：
民法是市民社会的根本大法,充满着自主性的品格;民法的实现构成了现代法治的最为重要的基础,在民法实现的过程中主体获得了自主性的发展,法治也具有了自主性的品格,而自主性的精神的内化则构成了现代法治的起点。
Abstract：
Civil law is a fundamental law of society of citizens,and it is of high autonomy.The realization of civil law forms the most siginificant basis of the modern rule by law,where subjects achieve autonomous development,and rule by law is of autonomous virtue,with autonomous spirit being the starting point.
