The new legal realism and the pre-sale of the real estate
摘要/Abstract
摘要：
"新法律现实主义"以现实主义的中立态度,目标为解决问题的法学研究方法和立场,以事实及具体问题为出发点,对探寻房地产预售法具有重要的理论和现实意义。它带来经验实证研究方法的新趋向,发现我国房地产预售制度的本土特征(垄断);它帮助发现房地产预售纠纷中"放弃"是主要的救济途径,需要我们探寻房地产预售法设计的形而上缺陷;它使我们正视房地产非法预售中的法律边缘化倾向,积极寻找解决问题的"疏导"治理机制。
Abstract：
The new legal realism takes neutral and legal approaches to the real estate pre-sale mechanisms. This research adopts an empirical study of the indigenous characteristics,like monopoly.It is found that giving up is a dominating method to deal with disputes,and the law has been marginalized, which motivates self protection and for the good in real estate transactions.
