Reconstruction of certain acts of the Chinese criminal law
摘要/Abstract
摘要：
刑法分则中"毒品"、"淫秽物品"等概念的解释性规定,按照总则与分则的关系要求应该纳入总则规定;刑法分则体系应改"大章制"为"小章制"的分类方式;并入"侵犯公民人身权利、民主权利罪"的妨害婚姻家庭罪应当独立成章;增设侵害环境罪专章,将刑法第六章"妨害社会管理秩序罪"中的第六节"破坏环境资源保护罪"独立成章;贪污贿赂罪涵盖的内容应当加以扩展,将非国家工作人员受贿罪、对非国家工作人员行贿罪等几个罪纳入第八章规定的"贪污贿赂罪"。
Abstract：
In the criminal law,drug,pornographic and other provisions should be moved to the general principles from the sub-rules;the general chapters should be detailed;the violation of civil and democratic rights to impinge marital families should be an independent chapter;the environment-related crimes should be an independent chapter;the corruption and bribery should be more detailed in the provisions of Chapter VIII
