On improvement of the administrative investigation
摘要/Abstract
摘要：
行政调查是行政决定不可或缺的一个环节,违法或不当行政调查对公民权利极具侵害性。目前,我国尚无行政程序法法典或行政调查法对行政调查从实体和程序方面对其予以系统规制。从保障公民权利、构建法治政府的需要起见,借鉴两大法系主要国家的经验,依托行政法的基本原则,构建行政调查制度,规范行政调查,具有重要的现实意义。
Abstract：
Administrative investigation is an integral part of an administrative decision,and anything illegal or improper may harm highly the civil right of citizens.Since there is no code nor rule of administrative procedure,this paper discusses the potential establishment of the law or concerned regulations on the basis of the experienced nations,and basic principles of the administrative law.
