Xunzi and his legal ethics
摘要/Abstract
荀子的法伦理思想对当今法治建设至少具有以下启示:第一,治国安邦,法律必不可少;第二,治国安邦决不能唯法是用,而是必须优先重视道德文化建设;第三,理想的法律必须是仁爱、公平精神的象征,否则,法律自身的合法性就应受到质疑,其对社会成员的约束力也将大打折扣;第四,法律必须遵循功赏相当、罪罚相应、奖惩分明的公正原则;第五,统治者必须首先遵纪守法,才能保证法律的顺利实施;第六,荀子主张以法律手段禁绝儒家以外的其他学说,以此实现思想统一,这一文化专制的法伦理思维模式必须为当今法治建设摒弃。
The legal ethics by Xunzi presents the following illuminations for the current rule by law: 1.Law is inevitable for the national administration.2.Law is not almighty,so the moral construction is equally important.3.The ideal law should be both benevolent and equal,or otherwise debatable.4.Law should abide by the fair play of reward for virtue and punishment for vice.5.Rulers take the lead in observation of law.6.Law rules that Confucianism is exclusively executed.His ideological monopoly violates the modern legal construction
