On the Protection of Property Rights for Private Entrepreneurs by Local Governments in the Song Dynasty
摘要/Abstract
宋代随着商品经济的发展，民间工商业者、借贷业者之社会地位日益提高，统治者为增加财政税收，出台了多种法令对民间经营者的财产权益予以保护。宋代地方各级政府在日常政务管理中也因地制宜出台相关举措，切实保护民间经营者市场交易资产、合法借贷资产和其家庭资产，这些举措有助于吸引外地经营者到本地开展经营活动，从而促进了民间经营资本的成长和壮大。宋朝国家从农业之外的工商业、茶盐酒等禁榷品等领域获得越来越多的收益，其中也包含了各级地方政府不断探索，为民间资本创造条件营运贸易，加强扶植保护所做出的贡献，这也表明宋代民间工商业、借货业的繁荣发展，并非历史的虚像，是有其客观基础的。
With the development of the commodity economy during the Song Dynasty(960-1279),the social status of private industrial and commercial entrepreneurs as well as moneylenders gradually improved.To increase fiscal revenue,the ruling class introduced various decrees to protect the property rights of private entrepreneurs.Local govemments at various levels also implemented context-specific measures in their daily administrative practices to effectively safeguard private entrepreneurs'assets in market transactions,lawful lending activities,and family wealth.These efforts helped attract entrepreneurs from other regions to conduct business locally,thereby fostering the growth and expansion of private commercial capital.The Song state dernived increasing revenue from sectors beyond agnicuture,such as industry,commerce,and statemonopolized commodities like tea,salt,and alcohol.This was partly attibutable to the continuous exploration by local govemments at alllevels to create favorable condtions for private capital in tade operations and to strengthen support and protection measures.This indicates that the flounishing development of private industry,commerce,and moneylending in the Song Dynasty was not merely a historcalillusion but was grounded in a tangible and objective foundaton.
