Establishing Tort Liability for Generative AI Conduct: A Phase-Specific Accountability Framework

摘要:

生成式人工智能的发展为人类社会带来了一系列挑战,但其工具地位并未改变。在此前提下,明确生成式人工智能行为侵权责任的认定有利于正确引导生成式人工智能的发展。生成式人工智能行为在训练、生成、删除的不同阶段侵权风险不同,在侵权责任的认定中需要明确认定标准、行为的符合性以及承担该责任的方式。基于对新技术“引导性”的规制,过错责任原则更符合生成式人工智能的发展需要。在适用中,应结合服务提供者的安全保障义务构建两阶段、多等级的安全保障义务体系进行合理的限制。在责任承担上,一般适用传统侵权法判断方式选择责任承担形式,同时基于生成式人工智能侵权风险的延续性,在生成式人工智能服务提供者间接侵权时分别认定连带责任与相应的补充责任。

Abstract:

While generative artificial intelligence (GenAI) poses significant societal challenges, its fundamental status as a tool remains unchanged. Clarifying tort liability determinations for GenAI conduct is therefore essential to properly guide its development. Distinct infringement risks emerge across operational phases—training, content generation, and data deletion—necessitating precise liability criteria, conduct assessments, and appropriate accountability mechanisms. Given the need for developmental regulation of emerging technologies, the fault liability principle best serves GenAI’s advancement. Implementation requires establishing a dual-phase, multi-tiered safety obligation framework for service providers to ensure reasonable constraints. For liability allocation, traditional tort law principles generally determine remedies; however, due to GenAI’s persistent infringement risks, joint liability and proportionate supplementary liability apply distinctly when service providers engage in indirect infringement.
