摘要/Abstract
家庭在中国几千年的传统社会当中始终处于立法的核心地位。在传统社会立法者的支持下，家庭在维护社会秩序方面发挥着基础性作用。随着现代化过程的推进，个人主义思潮影响下的现代立法逐步削弱了家庭在法律当中的主体地位。家庭法律地位的下降使其本身的基础性作用不再具有发挥社会治理能效的空间，并由此产生了些许不良影响，这种不良现象至今仍然存在以至于影响到家庭作为法律主体的作用发挥，因此，家庭在当代法律中的地位有必要得到强化。基于此目的就更加有必要梳理我国家庭法律地位上的演化进程以及关于家庭制度构建的相关理论，为当下的家庭立法提供不同角度的路径探索。
The family has historically been central to Chinese legislation, serving as a fundamental pillar for social order in traditional society. However, modernization and the rise of individualism have gradually diminished the family’s legal prominence, limiting its effectiveness in social governance and leading to negative repercussions that persist today. This decline undermines the family’s role as a legal subject, necessitating a reassessment and reinforcement of its status in contemporary law. To address this, it is essential to trace the historical evolution of the family’s legal standing and explore relevant theories that inform family system construction in China, thereby offering new perspectives for current family legislation.
