论新文科建设中的法学教育——从法官的社会认同困境谈起

Legal Education in “New Social Science”: An Analysis of the Predicament of Chinese Judges’ Social Identification

我国传统法学教育往往以西方话语体系为主导,旨在培养法学生建立西方语境下的法律思维,并将这种法律思维视为“法律人”的行为准则。但是,这种法律思维有时难以解决中国现实问题。接受了传统法学教育的中国法官在面对这种难题时,难以反思西方理论,反而容易将社会文化与法律对立,进而产生社会认同障碍。因此,在我国新文科建设之法学教育改革中,一个重要目标是建立中国话语体系下的法学教育,培养法学生用中国实践检验和修正西方法学理论。

Abstract:

Legal education in China tends to be dominated by the Western discourse system. It aims to equip the law students with a so-called legal thinking which is usually in line with Western context, and which they wish the students to regard as the code of conduct for “legal professionals.” However, such legal thinking sometimes has difficulties to solve China’s factual problems. When facing such dilemma, Chinese judges who have received legal education are often not willing to challenge Western theories. On the contrary, they tend to antagonize social culture and law, which leads to predicament of their social identification. Therefore, an important goal of legal education in the construction of “New Social Science” should be to establish a legal education under the Chinese discourse system, and to train law students to use Chinese practice to falsify Western theories in a pragmatic way of thinking.
