Protection of Christianity and punishment of Chinese in the late Qing dynasty

摘要：
从法律角度看，19世纪下半叶反洋教活动固然和善后过程中处置不当而产生的抑民保教有关，也和中国传统法律的缺陷有关，外国传教士和外交官施加的压力只是恶化了抑民保教的程度。如从重惩办肇事者等规定使清政府无意中承担了本不属于自己的责任，国家承担赔偿则是主动承担了“国家责任”。处分官员大体尚能比照《大清律例》，不全或大多不是屈从列强要求，但由于清政府上下惧怕列强干涉，迅速按例从快、从重给予处分，列强施加压力的影响主要表现在从严、从快和从重方面。这类惩办客观上纵容了传教士和教民的非法行为，这是制定法律者最初无法预料的。
Abstract：
This study relates the legal perspective of the protection of Christianity and punishment of Chinese in the late Qing dynasty in the latter part of 19th century. The argument is that all this is due to power of western missionaries and foreign diplomats, in addition to the inadequate Chinese laws. The punishment is severe, sudden and strict, and the Christian missionaries are protected which is totally unpredicted for the law makers.
