摘要
建筑物区分所有权系现代民法一项基本的不动产所有权形式,我国目前也出现了大量的区分所有住宅。然而,由于种种原因,《民法通则》并未对此作出规定。为了弥补我国民事立法的空缺,也为了统一调整区分所有法律关系,有必要对我国现阶段建筑物区分所有权制度的特点、行使原则及立法模式的选择等问题做深入的研究。

On the legal system for the building differentiation ownership in our country

Abstract:
According to modern civil law,the building differentiation ownership is a basic form of ownership.At present,there have appeared a lot of residential quarters of differentiation ownership.However,there is not any regulation governing it in the General Rule of the Civil Law.In order to remedy the defect of the civil law and adjust the legal relation of differentiation ownership,it is necessary to do more profound research on the characteristics of the present building differentiation ownership,the principle of exercise and the pattern of legislation.
